BE READY… TO MANAGE PERFORMANCE AND CONDUCT

BE READY… TO GET PROBATION RIGHT

Managing people does not always feel straightforward. Many workplace problems become more difficult because concerns are not raised early enough, expectations are unclear or managers do not feel confident having honest conversations.

From January 2027, employees will qualify for ordinary unfair dismissal protection after six months’ service. Employers will therefore need managers who can identify concerns, respond appropriately and demonstrate that fair and reasonable steps have been taken.

This practical masterclass will help managers distinguish between performance, conduct and capability concerns and choose the right approach. It will provide a clear framework for addressing issues early, holding effective conversations and moving into a formal process when necessary.

During the session, we will cover:

  • The difference between poor performance, misconduct and capability
  • Identifying the real issue before deciding what action to take
  • Why managers avoid difficult conversations and the risks of delay
  • Raising concerns clearly, fairly and at an early stage
  • Setting reasonable and measurable expectations
  • Giving constructive feedback that employees can understand and act upon
  • Creating appropriate records without making the process unnecessarily complicated
  • Deciding when informal management is appropriate
  • Knowing when a formal capability or disciplinary process is required
  • Investigating conduct concerns fairly
  • Warnings, improvement periods, support and review
  • Considering health, disability and reasonable adjustments
  • Reaching fair and evidence-based decisions
  • Recognising when dismissal may become an appropriate outcome

This will be an interactive session based on the situations managers regularly face. Attendees will have the opportunity to work through practical examples and consider how they would handle challenging conversations and decisions.
